Privacy Policy

This Privacy Policy describes how Sail-IQ sp. z o.o., registered in Poland with its registered office at 81-524 Gdynia, ul. Świętopełka 45, VAT ID: 7393966446 (“Controller”, “Company”, “we”), processes personal data in accordance with Regulation (EU) 2016/679 (“GDPR”).

1. Data Controller

2. Scope of Personal Data

The Company may process the following categories of data:

  • first and last name,

  • login credentials,
  • billing and payment references,
  • IP address,
  • browser and device information,
  • system usage data,
  • sailing data (including GPS tracks),
  • content uploaded to the Service.

GPS tracks are historical and not real-time data.

3. Purposes of Processing

Personal data is processed for the purpose of:

  • providing the Service,
  • performing the contract,
  • handling payments,
  • communication with Users,
  • technical support,
  • improving Service functionality,
  • fulfilling legal obligations.

4. Legal Bases

Data is processed based on:

  • Article 6(1)(b) GDPR – performance of a contract,
  • Article 6(1)(c) GDPR – legal obligation,
  • Article 6(1)(f) GDPR – legitimate interest,
  • Article 6(1)(a) GDPR – consent.

5. Data Recipients

Data may be transferred to:

  • hosting providers,
  • payment processors (e.g. Stripe),
  • accounting service providers,
  • IT and security service providers.

All recipients process data under GDPR-compliant agreements.

6. Data Transfers Outside the EU

Data may be transferred outside the EU only when appropriate safeguards are applied in accordance with GDPR, including Standard Contractual Clauses.

7. Data Retention

Personal data is stored:

  • for the duration of the contract,
  • after termination for the period specified in the Terms of Service,
  • longer if required by law.

The User has the right to:

  • access personal data,
  • rectify data,
  • erase data,
  • restrict processing,
  • data portability,
  • object to processing,
  • withdraw consent at any time,
  • lodge a complaint with the Polish Data Protection Authority (UODO).

9. Obligation to Provide Data

Providing personal data is voluntary but necessary to use the Service.

10. Automated Decision-Making

The Company does not apply automated decision-making or profiling within the meaning of GDPR.

11. Data Security

The Company applies appropriate technical and organisational measures, including:

  • encryption,
  • access control,
  • backups,
  • system monitoring.

Rules regarding cookies are described in a separate Cookie Policy.

13. Policy Updates

The Company may update this Privacy Policy. The current version is always published on the Service website.
